Police officials have reported that a man who was struck by a drunk driver on Highway PR-2 in Villa Caparra, Guaynabo on June 25, 2018, has died.
According to reports, Giovanni Otero Hernandez, 22, was driving a 1998 Toyota Corolla towards Bayamon when his vehicle was slammed by a 2001 Nissan Pathfinder driven by Gabriel Vazquez Soto, 36. Police reports say that Otero Hernandez was traveling in the opposite lane of Hernandez when he turned left across traffic to pull into a gas station and was t-boned by Vazquez Soto.
While the police reports suggest that Otero Hernandez may not have used the proper precautions before making the turn, Vazquez Soto was taken to the police station and given a breath test which showed the driver had a blood alcohol concentration of .12.
The case is being investigated by the Bayamon Police Department.
Your Rights in Automobile Accidents
Car crash victims and their families in Puerto Rico may be entitled to seek justice and compensation for their injuries, even if they had something to do with the accident. While current investigations suggest Otero Hernandez may not have used his turn signal before turning across traffic, Vazquez Soto allegedly had a blood alcohol content that was far above the legal limit. If police investigations show that Vazquez Soto was indeed drunk driving, it is possible that he could be held partially liable for the victim’s injuries and resulting death.
